70% of the cases filed are Chapter 7 cases. In a Chapter 7 case, most debts are "dischargeable". You are allowed to keep all property that is exempt under the Nevada Bankruptcy Exemption Code. In most cases, all of your property will be exempt. Typical legal fees are $851 for a chapter 7 plus $299 for the filing fee.
Chapter 13 Bankruptcy: certain debts can be discharged in a chapter 13 that cannot be discharged in a chapter 7. In a chapter 13, you have the right to stop a foreclosure proceeding and cure mortgage arrearages over a reasonable period of time. This can save your property. A chapter 13 can be used to resolve IRS problems. In a chapter 13, you must propose a plan that will govern payments the payments that you will make to the court over a 3-5 year period. Typical legal fees will range from $2,000 -$4,000 The majority of which is paid over time. Since the fee's are higher, some attorney's will push you into a chapter 13. If a chapter 13 will not help you, you should file a chapter 7.
Chapter 11 & 12 are for business and farmers and can be used to re-organize business and agricultural debts. The fees for these chapters are quite substantial.
